I filed the complaint against Gonzalez General Contracting over 3 months ago, and have yet to have our job completed. Our 6 week project has not been completed in over 5 months. The BBB site indicates that Gonzalez has agreed to comply with the contract. THIS IS INCORRECT!. In fact Gonzalez has stated he WILL NOT comply with the terms of the contract, even though he took our money.
Though the contract says Gonzalez will provide all material and labor, and pay a penalty for each day that he misses the agreed upon completion date, he refuses to buy materials or pay the contractual penalties. The CSLB has opened an investigation of Gonzalez' business practices. They have given him several opportunities to comply with the contract requirements as well.
Update 11/27/08: Gonzalez has abandoned our project and we have not seen or heard from him since 20 November, though on 11/20 he again claimed that he would make good on completing the job. He told us that he didn't care if we sued him for breach of contract because he has no assets to make us whole.
Update 07/31/09: We had to take Gonzalez before an arbitrator to force him to comply with the terms of the contract, and reimburse us for the cost we had to pay others to complete what he would not in our home. Rather than show any humility, Gonzalez countersued us for the the money that I held back, even though he never finished our home. Both his insurance bond company and the arbitrator decided against Gonzalez. We hung in there for 8 months. We have been extremely inconvenienced by Gonzalez, but it was truly worth the effort and all the work. Gonzalez was ordered to comply with the terms of the contract and reimburse us for the additional costs we incurred to complete our home, but his lack of character and integrity would suggest that it will take a lot more of legal wrangling before he does what's right.
